This website is operated by Ziggys Miami. The terms "we," "us," and "our" refer to Ziggys Miami. Ziggys Miami operates this store and website, including all related information, content, features, tools, products, and services, to provide you, the customer, with a curated shopping experience (the "Services"). Ziggys Miami is powered by Shopify, which enables us to provide the Services to you. By visiting, interacting with, or purchasing from our site, you engage in our "Service" and agree to be bound by these Terms of Service, together with our Privacy Policy and all additional policies referenced herein. SECTION 1 — AGE REQUIREMENT

You must be 21 years of age or older to browse, access, or purchase any products from Ziggys Miami. By placing an order, you represent and warrant that you are at least 21 years of age. We reserve the right to cancel any order and refuse service if age verification cannot be confirmed.

SECTION 2 — HEMP COMPLIANCE AND FEDERAL LAW

Ziggys Miami operates in full compliance with the Agriculture Improvement Act of 2018 (the "2018 Farm Bill"), which federally legalized hemp and hemp-derived products containing no more than 0.3% Delta-9 THC on a dry weight basis. By purchasing from Ziggys Miami, you acknowledge and agree that:

(a) All applicable hemp-derived products sold by Ziggys Miami contain less than 0.3% Delta-9 THC in accordance with federal law.

(b) It is your sole responsibility to verify and comply with the laws of your state, county, and municipality regarding the purchase, possession, and use of hemp-derived products before placing an order.

(c) Ziggys Miami does not ship hemp-derived products to states or localities where such products are prohibited by law. It is the buyer's responsibility to confirm legality in their jurisdiction prior to ordering.

(d) Hemp products sold on this site are not intended to diagnose, treat, cure, or prevent any disease. Statements regarding our products have not been evaluated by the Food and Drug Administration (FDA).

(e) All smoking accessories sold by Ziggys Miami are intended for use with legal hemp, tobacco, or other lawful substances only. Our products are not intended for use with any illegal or controlled substances.

(f) You assume all legal responsibility for the purchase, possession, and use of all products ordered from our store.

SECTION 3 — ACCESS AND ACCOUNT

By agreeing to these Terms, you represent that you are at least 21 years of age and reside in a jurisdiction where the purchase and use of our products is lawful. To use the Services, you may be asked to provide certain information, such as your email address and billing, payment, and shipping information. You represent and warrant that all information you provide is correct, current, and complete. You are solely responsible for maintaining the security of your account credentials and for all activity under your account. You may not transfer, sell, assign, or license your account to any other person.

SECTION 4 — OUR PRODUCTS

We have made every effort to display our products and services as accurately as possible. However, colors and product appearance may differ from how they appear on your screen depending on your device and settings. We do not warrant that the quality or appearance of any product will meet your expectations. All product descriptions and pricing are subject to change at any time without notice. We reserve the right to discontinue any product and to limit quantities offered to any person, geographic region, or jurisdiction on a case-by-case basis.

SECTION 5 — ORDERS

When you place an order, you are making an offer to purchase. Ziggys Miami reserves the right to accept or decline your order for any reason at its discretion. Your order is not accepted until we confirm acceptance, and we must receive and process your payment before your order is accepted. You represent and warrant that your purchases are for your own personal use and not for commercial resale or export. Your purchases are subject to our Refund Policy.

SECTION 6 — ORDER CANCELLATIONS

Orders may be cancelled within 24 hours of placement, provided the order has not yet shipped. Once an order has been fulfilled and shipped, it cannot be cancelled.

SECTION 7 — PRICES AND BILLING

All prices are listed in U.S. dollars and are subject to change without notice. The price charged will be the price in effect at the time the order is placed, as set out in your order confirmation email. Posted prices do not include taxes, shipping, or handling unless expressly stated. You agree to provide current, complete, and accurate purchase, payment, and account information for all purchases. You represent and warrant that the payment information you provide is true and correct, that you are authorized to use the payment method, and that you will pay all charges incurred at the posted prices, including shipping and applicable taxes.

SECTION 8 — ALL SALES FINAL / RETURNS

Due to the nature of our products, all sales are final. We do not accept returns or exchanges on opened, used, or consumed items. If you receive a defective or incorrect item, please contact us within 7 days of delivery at support@ziggysmiami.com with photos of the item and your order number. Refunds, if approved, will be processed to the original payment method within 10 business days. Full details are set out in our Return & Refund Policy.

SECTION 9 — SHIPPING AND DELIVERY

We ship only to states and jurisdictions where the purchase and possession of our products is permitted by law. We do not ship to any jurisdiction where hemp-derived products or smoking accessories are prohibited. Shipping times are estimates only and are not guaranteed. We are not responsible for delays caused by carriers, customs, or circumstances beyond our control. Risk of loss and title for purchased items pass to you upon delivery of the items to the carrier.

SECTION 10 — INTELLECTUAL PROPERTY

Our Services, including all trademarks, brands, text, displays, images, graphics, and the design, selection, and arrangement thereof, are owned by Ziggys Miami, its affiliates, or licensors and are protected by U.S. and foreign intellectual property laws. These Terms permit you to use the Services for your personal, non-commercial use only. SECTION 12 — RELATIONSHIP WITH SHOPIFY

Ziggys Miami is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with Ziggys Miami. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Ziggys Miami, including any injury, damage, or loss resulting from purchased products and services. You expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Ziggys Miami.

Hemp-derived products have not been evaluated by the FDA and are not intended to diagnose, treat, cure, or prevent any disease. You acknowledge that by purchasing and using our products, you do so at your own risk and assume all responsibility for their proper and lawful use.

SECTION 17 — LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO CASE SHALL ZIGGYS MIAMI, OUR DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, OR SUPPLIERS BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCTS PROCURED USING THE SERVICES, EVEN IF ADVISED OF THEIR POSSIBILITY.
