What the 2018 Farm Bill Says
The Agriculture Improvement Act of 2018 federally legalized hemp and hemp-derived products in the United States. It defines hemp as Cannabis sativa L. and any part of that plant with a delta-9 tetrahydrocannabinol concentration of not more than 0.3 percent on a dry weight basis. THCA is a separate cannabinoid — not Delta-9 THC itself. Hemp-derived products that contain less than 0.3% Delta-9 THC fall within the legal definition of hemp under federal law.
State Laws: Where It Gets More Complex
While federal law permits hemp-derived THCA products, individual states have enacted their own regulations. Some states restrict or ban certain hemp-derived cannabinoids, including THCA.
